Internal review of Council decision
If you are dissatisfied with a decision made by Council, or on behalf of Council, you can seek an internal review of that decision under section 270 of the Local Government Act 1999.
Internal reviews are a legal mechanism for a party to request a decision of the Council (including officers exercising their delegations) be reviewed by an independent officer or third party.
Internal reviews are normally undertaken on significant matters where the complaint handling processes have been exhausted. However, you can use the internal review mechanism at any time to review a decision made by Council or on behalf of Council.
Before making an application
Before making an application, please make sure you have read our Internal Review of a Council Decision policy and Internal Review of a Council Design Process.
Your application must be made in writing and include:
- The decision you are seeking to have reviewed and your interest in that decision.
- The reasons why you believe the decision is wrong.
- The outcome you are seeking.
- Your daytime contact details.
- A fee of $20.
Applications must be made within 6 months of the decision that you are seeking a review of (although we may consider your application made outside of this timeframe in exceptional circumstances).
There are some decisions that you cannot seek an internal review on, for example, if legislation has already established a mechanism for review of that type of decision.
