Applications on public notification
Major reforms to South Australia’s planning system have impacted how the public is notified about new development.
Performance-assessed development is subject to public notification, but developments envisaged in a Zone may be excluded from public notification, as they are reasonably expected.
Performance-assessed development means the proposal is assessed on its merits by an assessment manager or Council Assessment Panel.
The general public is notified through the placement of a sign on the proposed site during the notification period, which is 15 business days; some rural properties may be exempt from placing signage.
The sign must be at least A3 in size and displayed on or within a reasonable distance of the public road frontage. For properties with multiple frontages, a sign may be required for each frontage.
Neighbours within 60 metres of the proposed development are also notified in writing by letter or registered mail.
Any person who makes a representation about the development may request to be heard by the Council Assessment Panel, but once a decision is made, no appeal rights apply.
Public notices
Current Public Notices (after 19 March 2021)
Public Notices made after 19 March 2021 are assessed under the Planning Development and Infrastructure Act 2016. Certain types of applications will be categorised as requiring notification to adjoining property owners and placing a public notice on the property. These are available for view on PlanSA's Notified Developments or at the Nuriootpa Principal Council Office. Proof of identity is needed to obtain copies of these plans and a fee is payable. If you decide to make a representation as an alternative to making an online representation, you can do so by filling out the Statement of Representation Form.
