Footpath trading
Under the Local Government Act 1999, a business or organisation can apply for commercial use of a council footpath for outdoor dining or display of goods on a footpath.
The application form details the information required in order for us to assess an application. As part of the application, you will need to agree to comply with the permit conditions, provide confirmation of adequate public liability insurance and complete a risk assessment for the activity. We may prescribe additional conditions if considered necessary.
If the footpath is being used without a permit from Council, you may be fined a maximum of $2,500 or receive a $210 Expiation Notice. Council is currently undertaking an audit regarding the commercial use of footpaths in the area.
Council recently undertook a review of the fees and charges for outdoor dining and commercial uses of Council footpath permits, there are now two payment options available for business owners.
